Two Men Arrested for B&E After Returning to Scene of the Crime

Two men were arrested on June 26 in Medfield on multiple charges after allegedly breaking into a vehicle in the parking lot of the American Legion Post.

Medfield Police arrested two men on June 26 in the parking lot of the American Legion Post on Peter Kristoff Way after they allegedly “broke into” a man’s vehicle, according to police reports.

Mark Landry, 34, of 4 Overlook Dr., Franklin and Jeffrey Suereth, 18, of 89 Pleasant St., Medfield were arrested and charged with possession of a burglarious instrument (crowbar and screwdriver), attempt to commit a crime (larceny), conspiracy, breaking and entering a vehicle during the nighttime and intent to commit a felony. Landry also had a warrant out for his arrest from Dudley District Court for ID fraud.

Medfield Police received a call from a bartender at the American Legion Post at 10:29 p.m. reporting that “someone was going through” his motor vehicle, according to police reports. While officer Robert Flaherty was investigating the crime, Landry and Suereth returned to the American Legion Post parking lot.

“[Landry and Suereth] were caught because they returned to the parking lot while the officer was investigating the crime,” Medfield Chief of Police Robert Meaney Jr. said. “The officer stopped them and they were then identified by the vehicle owner as being the individuals in his car.”

Meaney said there was no damage to the bartender’s vehicle, nothing was reported stolen and the car appeared to be the lone target.

“We have no reason to believe that the Legion was the intended target, simply the car,” Meaney said.

The men were arrested and transported to the Medfield Police Station at 10:50 p.m. and held overnight with a $2,000 bail.

“They stayed in the Medfield Police lockup [overnight] and were transported to Dedham District Court [Monday] morning,” Meaney said. 

Meaney explains charges:

  • Breaking and Entering a Vehicle During the Nighttime: “Opening a door is technically ‘breaking,’ you do not have to damage the car. The intent is likely to steal something with significant value or even perhaps the car.”
  • Possession of Burglarious Instrument: "The instruments were hand tools (crowbar and screwdriver) that they had in their possession. Having tools with you is not an issue, the issue is having them with you while committing this type of crime, whether or not you used the tools at that particular scene.”
  • Conspiracy: “Because they were acting together.”
